7.1 GENERAL
The content published on the site is provided "as is" without any express or implied warranty of any kind. Michelin reserves the right to modify, correct, interrupt and/or delete content or access to the site at any time, without notice. Michelin cannot be held liable in the event of contamination of your computer equipment resulting from the spread of a virus or other computer infections. It is your responsibility to take all appropriate measures to protect your computer equipment.
Under no circumstances may Michelin, its employees, suppliers or partners mentioned on the site be held liable, whether under contract, tort or any other action, for any direct or indirect, incidental or consequential damage, or damage of any kind, or for any loss, particularly financial or commercial, resulting from use of the site or from any information obtained on the site.
It is strictly forbidden to create a hyperlink to unlawful content as defined in article 8.2. The site may contain simple or deep links to partner sites of Michelin or third parties, with the authorization of those third parties for deep links. Michelin has no control over these sites and therefore assumes no responsibility for their accessibility, relevance, availability, content, advertising, products and/or services available on or from these sites. Michelin is therefore not responsible for any direct or indirect damage that may arise from accessing or using the partner site, or from that site's failure to comply with any regulations.
7.2 INTERACTIVE SERVICES
Michelin is not required to monitor content published on the site by users. Michelin accepts no responsibility for such content or for verifying it; the user remains solely responsible for the harmful consequences of any content they publish. Michelin is nevertheless free to monitor all or part of the content at any time, before or after publication.
The user is solely responsible for the content they publish on the site. The user guarantees Michelin that they have all rights and authorizations required to publish this content. The user guarantees Michelin against any claim, demand, action or remedy by a third party alleging that all or part of the content published by the user on or through the site is unlawful, contrary to laws and regulations, public order, morality or this legal notice, infringes third-party rights or causes harm to a third party.
If Michelin is ordered to pay damages following legal action based on such grounds, the user who published the disputed content undertakes to reimburse Michelin for all sums Michelin has been ordered to pay, including attorneys' fees and legal costs.
Interactive services may include, without limitation, participation in forums or online discussions, posting comments and/or articles, voting in relation to different content, or establishing an interface between the site and your account on a social networking site.
8.1 REGISTRATION
Use of interactive services may require prior registration, for which you must complete a form. This registration gives you an account with a personal password. This password is required to access certain interactive services and must therefore remain strictly confidential. If it is forgotten or stolen, you must inform Michelin immediately.
Personal data will be processed in accordance with article 7 above, "Personal Data Protection".
8.2 USER CONTENT UPLOAD
You may also ask the moderator, at any time, to modify or delete content published under your name, taking care to indicate the publication date and subject of the content.
It is strictly forbidden to publish on the site any content, of any kind, that is contrary to laws and regulations, public order or morality, or that harms or infringes the rights of a third party, including content that is defamatory, abusive, obscene, discriminatory, threatening or contrary to the spirit of the site, infringes a third party's intellectual property rights, contains personal data relating to a third party, contains an image of a person who has not authorized such publication, or infringes a person's privacy without authorization.
8.3 UNLAWFUL CONTENT AND ABUSE
You acknowledge that moderation is implemented to monitor or delete content published by users of the Interactive Services that appears contrary to applicable laws and regulations, or that has been reported as such by the judicial authority, without you being entitled to any compensation.
In addition, if you fail to comply with this legal notice, you may be subject to the following measures: deletion of all or part of your content, suspension of your account for 8 weeks, or removal of your account and a ban on registering on all Michelin sites.
You may also report the publication of any unlawful content on the site that you become aware of by clicking "contact". Abuse of this option may expose you to liability.
Any dispute relating to the site or this legal notice shall be brought before the court of Clermont-Ferrand and governed and interpreted under French substantive law, independently of conflict of law rules. Use of the site constitutes the user's express agreement to this clause. If any provision of this legal notice is deemed illegal, void or unenforceable for any reason, it shall be considered not to form part of this legal notice and shall not affect the validity or application of the other provisions.
